New post-injury drug testing rules

The change prohibits retaliating against employees for reporting work-related injuries and illnesses.

Oregon OSHA recently published two new fact sheets that provide additional guidance and clarification to help employers understand how to comply with new recordkeeping rules that go into effect May 1, 2017. The new rules prohibit retaliating against employees for reporting work-related injuries and illnesses.

When federal OSHA enacted these rules in late 2016, they raised questions that required more clarity on a portion of the new rules that "prohibit employers from using drug testing, or the threat of drug testing, as a form of retaliation against employees who report injuries or illnesses." The new rules also affect how employers can use incentive programs.
